Egility Intelligence Inc., (“Egility”) greatly values your privacy and is committed to protecting your personal data. We maintain this Privacy Policy to articulate our commitment to your privacy. The policy covers how we collect, use, and disclose your personal information, the security measures Egility Intelligence employs to protect such data and your rights in relation to it.

We communicate our Privacy Policy to all employees, and strictly enforce the safeguards within Egility.

Who We Are

Egility is a talent advisory and executive search firm which collects, uses and stores a variety of personal data necessary to provide such services.

The Information we Collect

Recruitment Services

If you are a potential candidate for one of our executive search or executive interim assignments, categories of personal data we collect may include: contact information (e-mail address, address, telephone number), career history, education history, social activities, compensation details (where permitted by applicable legislation), professional experience, languages, photographs, individual performance and preferences, memberships, reemployment objectives, personality, character traits, professional style profile, executive competencies, interview notes as well as interview recordings and transcripts of such recordings (if applicable), identification data (civil/marital status, gender, nationality), and contact history where permitted by law.  This data may be obtained in e-mail correspondence, including information shared in a résumé, or CV or through publicly available sources and/or third parties such as sources/referees, your professional networking profile, news reports and our authorized background check providers.

In order to align our search process with our commitment to ensuring equal opportunities we may collect sensitive personal  information about you (in appropriate circumstances and in accordance with applicable local law) which may be classified as diversity information (such as your ethnic background, gender, disability, age, sexual orientation, religion or beliefs, and/or social economic background). Additionally, as some of our clients may be subject to employment diversity requirements Egility may be required to share such information insofar as it pertains to the search you are a part of.

Referee or Source Data

If you are an individual who provides a personal reference or feedback for a candidate (depending on the circumstances we may classify you as a Referee or Source), we may collect and process your contact details, certain professional details (such as title, occupation, qualifications and employment history) and your connection to the candidate. We may collect this information directly from you, the candidate or from publicly available sources. We will use this information to gather information on the relevant potential candidate such as your connection to, experience with, and opinion about such potential candidates. Any reference or feedback you provide about a candidate would not be attributed to you if shared with third-parties. We may also use your contact details to contact you in relation to any of our services that we believe may be of interest to you.

Client or Supplier Data

If you are an Egility client or supplier, we will collect and use information about your company and individuals within your company for the purposes of fulfilling our obligations to you and furthering our business relationship. Data collected will typically comprise your contact details (such as name, telephone number, email address, job title, and business record related to our services).

How we use personal information

We may use Personal Information to respond to your inquiries and answer your questions about our Services. We may use your Personal Information in order provide and improve the Services, such as sourcing, identifying, assessing, and retaining talent for executive or board positions and teams, sending you executive or board positions that may be of interest to you, assessing leadership teams and organizations in efforts to improve their performance and culture, providing advisory guidance on needs and trends for our clients, and sharing thought leadership that may be of interest to you. We also may use Personal Information for the purposes of securing our website and IT systems and other business administration purposes, including as necessary to meet our legal and compliance obligations or in connection with regulatory inquiries, audits, legal claims, subpoenas, warrants, or other government/judicial processes or requests.

Candidate and Assessment Data

The data is used in the usual course of our business to provide our services to clients. This may include assessing your suitability for executive and non-executive roles, presenting you as a prospective candidate to potential employers (Egility’s clients), contacting you for an assignment (executive search or executive interim) or verifying the details of your profile.

Your personal information may also be shared with third parties whom we have engaged to provide services such as education checks and/or background checks, to the extent that the checks performed are appropriate and in accordance with local legislation. This includes our third party service providers who perform functions on our behalf, such as outsourced document storage providers and interview transcription services, all of whom will be required to process your personal information in accordance with applicable data protection laws and this Privacy Policy. Your personal information may also be shared with Referees or Sources in order to obtain additional information about you so we can provide a more accurate profile to our clients.

Finally, your information may also be shared with any competent law enforcement, regulatory or governmental body, or a court of law if necessary to exercise our legal rights, protect your interests or as required by applicable law.

Referee or Source Data

We will use the collected data to obtain information regarding your experience with, and thoughts and opinions on a particular or potential candidate. If a candidate provides us with your details as a Referee, we may share your contact information with our clients to allow them to evaluate a candidate for a specific position. Any reference, opinion or feedback you provide to Egility as a Referee or Source shall in no case be attributed to you if shared with a client. We may also use your contact details to contact you in relation to any of our services that we believe may be of interest to you.

Client or Supplier Data

The data collected will be used in the context of the provision of our or your services. We may also use the data for other business purposes, including data analytics, benchmarking and statistic purposes. We may use the personal data collected to contact you in relation to any of our services that we believe may be of interest to you.

Intellectual Capital

We may contact you from time to time to share intellectual capital and thought leadership that we have published which we believe could be of interest to you or relevant to your role at your organization. You may opt out of receiving these communications at any time.

Events

From time to time we may contact you with an invitation to attend an industry- or role-specific event, such as a dinner or charity event. You may opt out of receiving these invitations at any time.

Market Intelligence

We may retain and use personal information for research, benchmarking, and market norms in order to provide and develop our services and intellectual capital, and remain aligned with market standards.

Disclosure of personal information

We share Personal Information with our business partners, including contractors who assist us in providing our Services, and internally with any of our affiliates, in which case our affiliates will handle your Personal Information in accordance with this Privacy Notice

We also disclose Personal Information to third party service providers, such as auditors, information technology providers or referees in order to provide the website or Services to help support our business operations. We also share Personal Information with our clients as necessary in connection with an executive or board search for opportunities that we believe are of interest to you, as well as in connection with providing advice in connection with our leadership advisory services. We reserve the right to disclose Personal Information in connection with the sale, assignment, or other transfer of all or part of the business, or where we believe such disclosure is required by law or is appropriate in connection with any legal claims, subpoenas, warrants or other government/judicial processes or requests, as well as to protect visitors or the company, or to comply with applicable law. We do not sell or rent your Personal Information.

Information Security and Integrity

Egility maintains reasonable technical and organizational measures to protect Personal Information from loss, misuse and unauthorized access, disclosure, alteration and destruction. To the extent that we disclose Personal Information to clients or third party service providers, we require that such third parties also maintain reasonable security and confidentiality measures and use the Personal Information in accordance with our instructions and applicable law.

Retention

We typically retain Personal Information related to marketing activities for as long as you accept marketing communications from us, and upon request, we will securely delete your Personal Information so that you can no longer be identified from it, in accordance with applicable law. For Personal Information that we collect and process for other purposes, as described above, we typically retain such Personal Information for no longer than the period necessary to fulfill the purposes outlined in this Privacy Policy, and as otherwise needed to address tax, corporate, compliance, litigation, and other legal rights and obligations, after which we will securely delete and/or take steps to properly anonymize your Personal Information.

Access to Personal Information – Your Rights

Where required by applicable law, you have the right to access, erase, correct, update or complete your personal data, or to request no further contact from Egility. Additionally, you have the right to request the transfer of your personal data to a third party, to object to the processing of your personal information, to ask us to restrict our processing of your personal information, or to withdraw your consent at any time. Should you request that we remove your personal information from our database, please note that we may retain a minimal amount of personal information about you record your wish for your data to be removed, and to keep a record of the information disclosed to our clients. If deletion (or anonymization if applicable) of your personal data is not possible (for example because your personal information has been stored in backup archives) then we will securely store your personal information and isolate it from any further processing until deletion is possible.

If we have collected and processed your personal information on the basis of your consent, you may withdraw your consent at any time. Withdrawing your consent will not affect any processing performed prior to your withdrawal nor will it affect processing on the basis of lawful processing grounds other than consent.

What Personal Information do we collect?

We collect information you provide to and use, and store any Personal Information you knowingly provide to us. When you apply for or discuss an opportunity with us, we may collect some or all of the following Personal Information:

  • your name, address and telephone number
  • email address and facsimile number
  • your location, if different from your address
  • your occupation and work history
  • compensation details
  • Information relating to results on leadership assessment tools used by us.

We also collect non-personal, technical information regarding the performance of the Services, as well as information about how you use our Services.We may add to our records from Personal Information we collect from other sources, including public online sources, your personal resume, and any discussions with you, your references, and those involved in the hiring regarding your candidacy.Information Collected Automatically

Whenever you interact with our services, we may automatically receive and record information on logs and databases from your browser, application, services or device(s).

Other information collected automatically may include your IP address, location details, “cookie” information, mobile device, operating system, the type of browser, application and/or device(s) you’re using to access our Services, click-through paths, the identity of the page or feature you are requesting or interacting with, time on page and other indicators of how you are interacting with the Services.

How do we use your Personal Information?

We use the information we collect to provide, maintain, protect and improve our Services, to develop new goods and services, to protect our users. Specifically, the main ways in which we use your Personal Information are as follows:

  • Considering and contacting you for suitable positions that arise
  • Keeping you apprised of relevant occurrences within our firm and industry

The security of your Personal Information is important to us

We will protect the Personal Information we have collected, whatever its form, by security safeguards appropriate to the sensitivity of the information. Note that if you are applying from outside of Canada, we follow Canadian Privacy Laws, which may be more or less stringent than those in place in the country in which you reside.

How long do we keep your Personal Information?

We retain your Personal Information only as long as we require it to fulfill the purposes for which it was collected, including to maintain an appropriate historical record of our relationship with you. If there are legal requirements relating to the period of time which we must retain your Personal Information, we comply with those requirements.

What if you want to limit the use of your Personal Information?

Most of the Personal Information we collect is necessary for us to discuss your candidacy for a position which you have applied for or agreed to explore. If you do not want us to use or disclose your Personal Information in a particular way, please contact using the contact information at the bottom of this Privacy Notice and we will be pleased to discuss with you how we can limit collection, use or disclosure of your Personal Information. Please note that if you place restrictions on our collection, use or disclosure of your Personal Information, our ability to provide to you our Services may be negatively affected.

You may request access and changes to your Personal Information

You may request access in writing to your Personal Information that is in our control and request corrections if you believe that Personal Information is inaccurate. If you wish to access or correct your Personal Information, you should contact us using the contact information at the bottom of this Privacy Notice and we will be pleased to discuss your request. Please note that all requests must be in writing.

Changes to our business

We may also share some or all of your Personal Information in connection with or during the negotiation of any merger, financing, acquisition or dissolution transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In the event of our insolvency, bankruptcy, or receivership, another organization may receive your Personal Information as a business asset.
